Reputation Management in Private Wealth

In this latest webinar in our private wealth series we tackled the issue of reputation management.  In a modern era with easy access to mass communication and the swift rise of new government policies in areas which have taken on a moral dimension such as tax, reputation management is becoming both harder and increasingly important.
 
In this webinar, Neil Blake, Joanna Caen, Richard Norridge and Brian Spiro discussed this complex topic.
 
Neil and Joanna outlined the key causes of action from a reputational perspective under English and Hong Kong law, including defamation, malicious falsehood, privacy claims and breach of confidence.  They also discussed key strategic considerations and the often differing approaches of legal advisers and PR representatives to reputational issues.
 
This included looking at the current, high-profile case of Donald Tsang (Hong Kong's former chief executive).  Following his recent trial on bribery and other charges, Mr Tsang was criticised by the Judge for his public relations tactics and required to pay increased costs as a result.
 
Drawing on his over 30 years' experience of acting for UNHW individuals, including in a number of high profile criminal matters, Brian Spiro looked at reputation management issues from the perspective of the criminal law.  He focused in particular on the introduction of Unexplained Wealth Orders. Under these orders, the UK authorities can freeze monies and other assets where it is not clear as to how they were legitimately obtained and then confiscate them unless a satisfactory explanation as to their provenance is given. He also provided a reminder on the new offence of failing to prevent assistance in the criminal evasion of tax.
